These Terms and Conditions set out the basis on which Rubbish Removal Balham provides waste collection and rubbish removal services to domestic and commercial customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and us.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer, you, your means the individual, business, organisation, or other entity that requests or uses our services.

Services means rubbish removal, waste collection, loading, transportation, and related services provided by us.

Waste means any rubbish, junk, household waste, commercial waste, garden waste, and other materials agreed to be removed by us, excluding prohibited items and hazardous waste unless expressly agreed in writing.

2. Scope of Services

We provide scheduled and one-off rubbish removal and waste collection services for residential and commercial customers. Our services generally include loading waste into our vehicles, transporting it to an authorised facility, and disposing or recycling it in accordance with applicable UK regulations.

The exact scope of the service, including the type and approximate volume or weight of waste, any access requirements and any additional labour or materials, will be agreed at the time of booking or as part of an on-site assessment.

We reserve the right to refuse to remove any items that we reasonably consider unsafe, prohibited, hazardous, illegal, excessively heavy, or otherwise unsuitable for collection.

3. Booking Process

3.1 Making a booking

You may book our services by telephone, email or online enquiry, where available. When making a booking, you must provide accurate and complete information regarding:

a. The collection address and access details.

b. The type, approximate volume and nature of waste to be removed.

c. Any special requirements or restrictions, such as limited parking, timing limitations or property access arrangements.

3.2 Provisional bookings and confirmation

All bookings are subject to availability and are not confirmed until we have accepted your request and, where required, you have accepted our quotation. We may confirm bookings verbally, by email, or by text message.

Where the scope of work or waste volume is uncertain, any price or time estimate provided before arrival at the site is an estimate only. The final quote will be confirmed on site once our team has inspected the waste and assessed access, parking and any other relevant conditions.

3.3 Changes to bookings

If you wish to change the time, date, address or scope of a booking, you must notify us as early as possible. We will try to accommodate reasonable changes, subject to availability. Changes may result in a revised quotation. If we cannot accommodate a requested change, the original booking and associated cancellation terms will apply.

4. Pricing and Quotations

4.1 Estimates and quotations

We may provide a guideline price estimate based on the information you provide. This is not binding and may be adjusted following an on-site assessment. The final price will be based on factors such as volume, weight, labour, access, time on site, and any disposal fees or supplementary charges applicable.

4.2 Additional charges

Additional charges may apply where:

a. The actual volume or type of waste differs from that described at the time of booking.

b. Access is significantly more difficult than reasonably anticipated.

c. Our team is kept waiting beyond a reasonable period for reasons beyond our control.

d. Extra labour, dismantling or handling is required to complete the job safely.

4.3 VAT and taxes

All prices are quoted exclusive or inclusive of VAT as expressly stated at the time of quotation. If applicable, VAT will be charged at the prevailing rate in accordance with UK law.

5. Payments

5.1 Payment methods

Payment is due in full upon completion of the service, unless we have agreed alternative terms in writing in advance. We may accept payment by cash, debit card, credit card, bank transfer or other methods made available from time to time. We are not obliged to accept cheques unless agreed prior to the service.

5.2 Deposit

We may require a deposit or partial prepayment for certain bookings, including large or commercial collections. Any required deposit will be notified to you at the time of booking. Deposits are generally non-refundable except where we cancel the service, subject to any statutory rights.

5.3 Late payment

Where account terms or invoicing arrangements are agreed, payment is due by the date specified on the invoice. We reserve the right to charge interest and reasonable recovery costs on overdue amounts in accordance with applicable UK law.

6. Cancellations and Rescheduling

6.1 Customer cancellations

If you wish to cancel or reschedule a booking, you must notify us as soon as possible. Cancellations made more than 24 hours before the scheduled arrival time will normally not incur a charge, save for any non-refundable deposits or third-party costs we have already incurred.

Cancellations made within 24 hours of the scheduled arrival time may incur a cancellation fee to cover our reasonable costs, including staff allocation and vehicle scheduling. If you fail to provide access at the agreed time or are not present where required, we may treat this as a late cancellation and charge a call-out fee.

6.2 Company cancellations

We aim to attend all bookings as scheduled but reserve the right to cancel or reschedule if affected by events beyond our reasonable control, including but not limited to severe weather, traffic disruption, mechanical breakdown, staff illness or operational issues. If we cancel, we will offer to reschedule at a mutually convenient time. Our liability for cancellation by us is limited to the return of any prepayment you have made for the affected service.

7. Customer Obligations

7.1 Access and parking

You are responsible for ensuring that our team has safe and reasonable access to the property and the waste to be removed, including arranging suitable parking where required. Any parking permits, access codes or instructions must be provided in advance or on arrival. You will be responsible for any parking charges, penalties or fines incurred as a result of insufficient or restricted parking information, unless directly caused by our negligence.

7.2 Waste description and preparation

You must accurately describe the waste to be collected and disclose any items that may be hazardous, sharp, heavy or difficult to handle. Waste should be reasonably accessible and not contaminated with substances that may pose health or safety risks. You must not include any prohibited items or hazardous waste unless we have explicitly agreed in writing to handle such materials in accordance with relevant regulations.

7.3 Permission to access

By booking our service, you confirm that you have the legal right or appropriate authority to allow us to access the property and remove the waste from the premises. You will indemnify us against any claim made by the property owner, landlord or any third party arising from our removal of items that you instructed us to take.

8. Waste Regulations and Prohibited Items

8.1 Compliance with law

We operate in accordance with relevant UK waste management and environmental regulations. Waste collected by us will be transported and disposed of at authorised facilities in compliance with applicable law. Where practicable, we will seek to reuse or recycle materials rather than send them to landfill.

8.2 Prohibited or restricted items

Certain items may be prohibited or require special handling, which may include but is not limited to asbestos, clinical or medical waste, chemicals, solvents, oils, pressurised containers, gas bottles, batteries, tyres, hazardous electronic waste or materials classified as dangerous goods. We reserve the right to refuse to handle such items or to apply additional charges where lawful disposal requires specialist treatment.

8.3 Misdescribed waste

If the waste differs materially from the description provided at the time of booking, we may revise our quotation, decline to proceed with part or all of the collection, or require that you remove prohibited items before we continue. If we incur additional costs due to misdescribed or improperly presented waste, we may charge you for those costs.

9. Performance of Services

9.1 Time of arrival

We will use reasonable endeavours to attend within any time slot or arrival window agreed. However, all times are estimates and not guaranteed. We are not liable for any loss or inconvenience arising from delays caused by factors beyond our control, including traffic conditions and access issues.

9.2 Health and safety

Our team will operate in a manner consistent with health and safety requirements. They may refuse to carry out any task that they consider unsafe, including lifting excessively heavy items, entering unsafe structures or handling hazardous materials. You agree to co-operate with reasonable safety instructions given by our staff while they are on site.

9.3 Completion of work

Once the agreed waste has been removed and the service is completed, we will request confirmation from you, where possible. Any concerns about the service should be raised at the time of collection or as soon as reasonably practicable thereafter.

10. Liability and Limitations

10.1 General liability

We will exercise reasonable care and skill in the provision of our services. Our liability for loss or damage arising from our services is limited as set out below and does not exclude any liability that cannot lawfully be limited or excluded under UK law, including liability for death or personal injury caused by our negligence or fraud.

10.2 Damage to property

While we take reasonable care when carrying out removals, minor scuffs or marks may occur where items are large or access is restricted. We will not be liable for pre-existing damage, wear and tear, or for damage that arises because access is unusually tight or hazardous and you have asked us to proceed regardless. You should remove or protect any items or surfaces that may be particularly susceptible to damage during normal carrying and loading operations.

10.3 Indirect and consequential loss

We will not be liable for any indirect, consequential, or purely economic loss, such as loss of profit, loss of business, loss of opportunity or loss of data, arising out of or in connection with our services, whether in contract, tort or otherwise.

10.4 Financial cap

Subject to any non-excludable statutory rights, our total aggregate liability to you for all claims arising out of or in connection with any single service shall not exceed the total fees paid or payable by you to us for that specific service.

11. Complaints and Disputes

We aim to provide a professional and reliable rubbish removal service. If you are dissatisfied with any aspect of our service, you should contact us as soon as possible, providing details of the issue and any relevant evidence. We will investigate your complaint and respond within a reasonable timeframe. Where appropriate, we may offer to remedy the issue, provide a partial refund, or take other corrective action at our discretion and in accordance with your statutory rights.

12. Data Protection and Privacy

We may collect and process personal information about you in order to manage your booking, deliver services, process payments and communicate with you. We will handle your personal data in accordance with applicable UK data protection legislation. We will not sell your personal data to third parties and will only share it where necessary to provide our services, comply with legal obligations or with your consent.

13. Force Majeure

We will not be liable for any failure or delay in performing our obligations where such failure or delay is due to events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, natural disasters, strikes, lockouts, accidents, war, terrorism, civil commotion, utility failures, or disruption to transport networks.

14. Amendments to These Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in law, industry practice or our operational requirements. The version in force at the time of your booking will apply to that service. Any material changes will be made available on request.

15. Severability

If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed severed from the remaining provisions, which will continue to be valid and enforceable.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the provision of our rubbish removal and waste collection services, shall be governed by and construed in accordance with the laws of England and Wales. You and we agree that the courts of England and Wales shall have exclusive jurisdiction to resolve any such disputes or claims, subject to any rights you may have as a consumer to bring proceedings in your local jurisdiction within the UK.
